What is an OUI?

  • Massachusetts calls drunk driving OUI. That means Operating Under the Influence of Alcohol. It is the same as DWI or DUI. 

Can I go to jail?

  •   Yes, the maximum penalty for a first offense Operating Under the Influence is 2 1/2 years in the House of Correction. However,  it is very rare someone goes to jail for a first offense and a skilled OUI attorney can explain all of the options available to you.

I got arrested for an OUI, is my license suspended?

  • Most likely. If you took a breathalyzer test and got a .08 or higher then your license is suspended for 30. If you refused to take the test your license is suspended for 180 days.

What is a hardship license and can I get one?

  • A hardship license is also known as a Cinderella license and is a restricted license issued by the Massachusetts Registry of Motor Vehicles. It is a 12 hour license that issued because of a work or education hardship. Hardships are only granted after the case is resolved. Hardship are not available for breathalyzer failures or refusals.  

What are the penalties for an OUI?

  • The standard penalties for a first offenses include probation, loss of license, fines and fees.

 Are there payment plans available?

 Are Roadblocks or Sobriety Checkpoints legal?
